1. Welcome

Welcome to the Silky Gem Affiliate Program.

We're excited to partner with creators, influencers, bloggers, and brand advocates who genuinely enjoy sharing our products.

By applying to or participating in the Silky Gem Affiliate Program ("Program"), you agree to comply with these Terms & Conditions. These terms govern your participation in the Program and your relationship with Silky Gem LLC ("Silky Gem," "we," "our," or "us").

If you do not agree to these Terms, please do not apply to or participate in the Program.

2. Eligibility

To participate in the Program, you must:

  • Be at least 18 years of age.
  • Provide accurate and complete application information.
  • Own or manage the social media account(s) used to promote Silky Gem.
  • Comply with all applicable local, state, federal, and international laws.
  • Comply with the policies of any platform on which you promote Silky Gem.

Submission of an application does not guarantee acceptance into the Program.

Silky Gem reserves the right to approve, reject, suspend, or remove any applicant or affiliate at our sole discretion.

3. Affiliate Program Overview

Once approved, affiliates may receive:

  • A unique referral link
  • A personalized discount code (when applicable)
  • Access to affiliate reporting
  • Marketing resources
  • Promotional campaigns
  • Product announcements
  • Exclusive affiliate opportunities

Affiliates earn commissions on qualifying purchases made through their approved referral link or coupon code, subject to these Terms.

4. Affiliate Responsibilities

As a Silky Gem Affiliate, you agree to:

  • Represent Silky Gem honestly and professionally.
  • Share truthful experiences and opinions.
  • Use your own original content whenever possible.
  • Promote products responsibly.
  • Maintain accurate account information.
  • Follow all FTC disclosure requirements.
  • Protect the reputation of the Silky Gem brand.

You are solely responsible for all content you publish.

5. Application Approval

Applications are individually reviewed.

Approval is based on factors including, but not limited to:

  • Content quality
  • Audience engagement
  • Brand alignment
  • Account authenticity
  • Compliance history
  • Overall fit with the Silky Gem brand

Silky Gem reserves the right to deny any application without providing a reason.

Applicants may reapply at a later date.

6. Affiliate Dashboard

Approved affiliates will receive access to an affiliate dashboard where they may:

  • View commissions
  • Track referrals
  • Monitor conversions
  • Access promotional materials
  • Update account information
  • Receive announcements

Affiliates are responsible for maintaining the confidentiality of their login credentials.

7. Commission Structure

Affiliates earn commissions only on verified qualifying purchases.

A qualifying purchase generally means:

  • A customer purchases through your approved affiliate link or coupon code.
  • Payment has been successfully completed.
  • The order has not been canceled, refunded, charged back, or determined to be fraudulent.

Commission percentages may vary depending on promotions, campaigns, or affiliate tier.

Silky Gem reserves the right to modify commission rates at any time.

8. Payment Terms

Commission payments are issued on a monthly basis for qualifying purchases that have successfully completed the applicable return period.

To receive payment, affiliates must maintain accurate payment information within their affiliate account. Silky Gem is not responsible for delayed or failed payments resulting from incomplete or inaccurate account information.

Silky Gem reserves the right to withhold or adjust commissions resulting from:

  • Returned orders
  • Refunded orders
  • Chargebacks
  • Fraudulent transactions
  • Duplicate commissions
  • System errors
  • Self-referrals or prohibited purchases

Any overpayments made in error may be deducted from future commission payments.

Silky Gem reserves the right to establish or modify minimum payout thresholds and available payment methods at any time.

9. Returns, Refunds & Chargebacks

Commissions are earned only on completed and verified purchases.

If an order is canceled, refunded, disputed, or charged back, any commission associated with that order may be reduced, reversed, or withheld.

Silky Gem reserves the right to investigate unusual purchasing activity before approving commissions.

10. FTC Disclosure Requirements

Affiliates are responsible for complying with all applicable advertising and endorsement laws, including the Federal Trade Commission (FTC) Endorsement Guides and any similar regulations applicable in their jurisdiction.

Whenever promoting Silky Gem products, affiliates must clearly disclose their relationship with Silky Gem.

Examples of acceptable disclosures include:

  • #affiliate
  • #ad
  • "I earn commissions from qualifying purchases."
  • "This post contains affiliate links."

Disclosures should be clear, easy to understand, and placed where consumers are likely to notice them.

Failure to provide proper disclosures may result in suspension or removal from the Affiliate Program.

11. Brand Guidelines

Affiliates are encouraged to create content in their own unique style while representing the Silky Gem brand accurately and professionally.

We value authentic reviews and genuine experiences over scripted promotions.

When describing Silky Gem products, affiliates are encouraged to use accurate language such as:

  • Handcrafted Crystal Candy
  • Delicate crunchy shell
  • Firm jelly-like center
  • Beautiful jewel-inspired appearance
  • Balanced sweetness
  • Unique texture

Affiliates should avoid making exaggerated or misleading statements regarding the products.

12. Prohibited Claims

To protect our customers and maintain brand consistency, affiliates may not claim or imply that Silky Gem products:

  • Provide medical or health benefits.
  • Cure, prevent, or treat any illness.
  • Are "glass candy."
  • Are impossible to bite.
  • Break teeth.
  • Are sugar-free unless specifically labeled.
  • Are organic unless specifically labeled.
  • Are vegan unless specifically labeled.
  • Are gluten-free unless specifically labeled.

Affiliates may not intentionally misrepresent product ingredients, flavors, availability, or nutritional information.

13. Content Standards

We encourage creative freedom while maintaining a positive brand image.

Affiliates should create content that is:

  • Honest
  • Respectful
  • Family-friendly
  • Original
  • Authentic
  • Informative

Content must not include:

  • Hate speech
  • Harassment
  • Discrimination
  • Illegal activities
  • Dangerous product misuse
  • Graphic violence
  • Pornographic material
  • False testimonials
  • Artificial reviews generated to mislead consumers

Silky Gem reserves the right to request removal of content that conflicts with these standards.

14. Intellectual Property

All trademarks, logos, product names, photographs, videos, graphics, packaging designs, website content, and other materials provided by Silky Gem remain the exclusive property of Silky Gem LLC.

Affiliates are granted a limited, non-exclusive, revocable license to use approved Silky Gem marketing materials solely for the purpose of promoting Silky Gem products through the Affiliate Program.

Affiliates may not:

  • Modify or alter the Silky Gem logo.
  • Register or use domain names, social media usernames, or business names that may cause confusion with the Silky Gem brand.
  • Claim ownership of any Silky Gem intellectual property.
  • Use Silky Gem branding in any manner that suggests an employment, partnership, or ownership relationship beyond participation in the Affiliate Program.

This license automatically terminates if an affiliate leaves or is removed from the Program.

15. Paid Advertising Policy

Affiliates may promote Silky Gem using their own content across approved platforms.

However, affiliates may not:

  • Bid on "Silky Gem" or confusingly similar keywords through Google Ads, Microsoft Ads, or other search advertising platforms.
  • Purchase advertisements that impersonate the official Silky Gem brand.
  • Use misleading URLs or display URLs.
  • Create websites designed to appear as the official Silky Gem website.
  • Use deceptive redirects or cloaking techniques.

Paid social media advertising using original affiliate content may be permitted only with prior written approval from Silky Gem.

16. Coupon & Promotional Code Policy

If Silky Gem provides you with a unique coupon code, it may only be promoted as authorized by Silky Gem.

Affiliates may not:

  • Publish unauthorized coupon codes.
  • Advertise expired promotions as active.
  • List affiliate codes on coupon or deal websites without written approval.
  • Misrepresent discounts or pricing.
  • Offer cash incentives, rebates, rewards, or other compensation to encourage purchases through their affiliate link unless expressly approved by Silky Gem.

Violation of this policy may result in forfeiture of commissions and removal from the Program.

17. Prohibited Activities

To maintain the integrity of the Affiliate Program, the following activities are strictly prohibited:

  • Fraudulent transactions.
  • Self-referrals or purchasing through your own affiliate link for personal gain.
  • Creating fake customer accounts.
  • Artificially inflating clicks or conversions.
  • Spam email or unsolicited direct messages.
  • Misleading advertising.
  • False reviews or testimonials.
  • Trademark infringement.
  • Copyright infringement.
  • Bot-generated traffic.
  • Cookie stuffing.
  • Incentivized purchases that have not been approved by Silky Gem.
  • Any activity intended to manipulate affiliate tracking or commission payments.

Silky Gem reserves the right to investigate suspicious activity and withhold commissions during any investigation.

18. Account Suspension and Termination

Silky Gem reserves the right to suspend or terminate any affiliate account at any time if we determine that an affiliate has:

  • Violated these Terms & Conditions.
  • Violated applicable laws or regulations.
  • Damaged or attempted to damage the Silky Gem brand.
  • Engaged in fraudulent or deceptive practices.
  • Misused affiliate links or promotional codes.
  • Failed to comply with FTC disclosure requirements.
  • Submitted false or misleading information during the application process.

Upon termination, affiliates must immediately discontinue use of all Silky Gem trademarks, logos, promotional materials, affiliate links, and coupon codes.

Silky Gem may withhold unpaid commissions while investigating potential violations of these Terms.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Silky Gem LLC shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from participation in the Affiliate Program.

This includes, but is not limited to:

  • Loss of revenue
  • Loss of profits
  • Loss of business opportunities
  • Data loss
  • Business interruption
  • Technical failures
  • Tracking errors
  • Payment delays beyond our reasonable control

Participation in the Affiliate Program is at your own risk.

20. Changes to the Affiliate Program

Silky Gem may update these Terms & Conditions, commission structures, promotional policies, or other aspects of the Affiliate Program at any time.

Updated terms will become effective upon publication on the Silky Gem website or upon notification through the affiliate dashboard or registered email address.

Continued participation in the Affiliate Program after such updates constitutes acceptance of the revised Terms.

21. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.

Any dispute arising out of or relating to the Affiliate Program shall be resolved in the state or federal courts located in Maryland, and affiliates consent to the jurisdiction of those courts.

 

22. Acceptance of Agreement

By submitting an application to the Silky Gem Affiliate Program, or by participating in the Program after approval, you acknowledge that you have read, understood, and agree to be bound by these Affiliate Program Terms & Conditions.

You further acknowledge that your continued participation in the Program constitutes ongoing acceptance of any future revisions made in accordance with these Terms.
